Home Wyoming Criminal Defense DUI

Are You in Need of a DUI Lawyer?

A DUI arrest can lead to serious legal problems. You may be concerned about going to jail, losing your driver's license, paying heavy fines, or having a criminal conviction follow you for years. You may also have questions about your job, insurance payments, or immigration status.

Steven Titus & Associates, P.C. represents people who are facing DUI charges throughout Wyoming. We work to identify weaknesses in the state's case and develop a strong defense based on the facts. Chemical tests and police investigations can be challenged when there are problems with how evidence was handled or obtained.

You may especially need an attorney if:

  • You have a prior DUI conviction.
  • Your alcohol concentration was allegedly high.
  • You refused chemical testing.
  • An accident occurred.
  • Someone was injured.
  • You hold a commercial driver's license.
  • Your job requires you to drive.
  • You live outside Wyoming.
  • You are concerned about immigration consequences.
  • You believe the officer did not have a valid reason to stop you.

How Can a Lawyer Help After a DUI Arrest?

Your Wyoming DUI attorney can examine the entire case rather than simply accepting the arresting officer’s conclusions. This may involve scrutinizing the circumstances surrounding your arrest and looking for legal or factual issues that may affect the case.

Our Wyoming criminal defense lawyer can:

  • Review the reason for the traffic stop to determine whether the officer had lawful grounds to stop your vehicle
  • Examine body-camera and dash-camera recordings
  • Compare video footage and other evidence with the written police report
  • Challenge evidence when there are legal or factual grounds to do so
  • Seek other appropriate relief based on the circumstances of the case
  • Negotiate with prosecutors
  • Advise you about possible outcomes
  • Protect your rights throughout court proceedings
  • Prepare your case for trial when necessary

What Are Wyoming's DUI Laws?

Wyoming law prohibits driving or having actual physical control of a vehicle when a person is under the influence of alcohol to a degree that makes the person incapable of safely driving, or under the influence of a controlled substance or combination of substances to that degree. The law also establishes different alcohol concentration limits depending on the driver:

  • Drivers age 21 and older: An alcohol concentration of 0.08% or more
  • Drivers under 21: An alcohol concentration of 0.02% or more
  • Commercial drivers: An alcohol concentration of 0.04% or more while driving or in actual physical control of a commercial motor vehicle

Defending Against DUI Charges

Being arrested for DUI does not automatically mean you will be convicted. Depending on the facts, several defenses may be available.

The Traffic Stop Was Unlawful

Police generally need a lawful basis to stop a vehicle. If the stop violated your constitutional rights, your attorney may be able to challenge evidence obtained afterward.

Field Sobriety Evidence Is Unreliable

Poor balance does not always mean intoxication. Medical conditions, injuries, footwear, weather, road surfaces, nerves, fatigue, and unclear instructions can affect performance. Video evidence may show whether the officer's description matches what happened.

Problems With Breath Testing

Breath-testing evidence can raise questions about the device, procedures, administration of the test, and other factors that may affect reliability. A DUI lawyer can examine the records surrounding the test instead of assuming the reported number is beyond challenge.

Problems With Blood Evidence

Blood evidence must be properly collected, documented, handled, and tested. A defense attorney can examine whether problems occurred at any stage.

The Officer's Observations Have Another Explanation

Red eyes, unusual speech, poor coordination, or fatigue may have causes other than alcohol or drug impairment. Medical issues, allergies, exhaustion, stress, and other conditions may become relevant.

The State Cannot Prove the Case

The prosecution has the burden of proving the charge. When evidence conflicts or important parts of the state's case are unreliable, an attorney can challenge whether that burden has been met.

Penalties for DUI Offenses in Wyoming

The possible punishment becomes more severe when a driver has prior DUI convictions.

For a first DUI conviction, Wyoming law generally treats the offense as a misdemeanor and permits up to six months in jail, a fine of up to $750, or both.

A second offense within 10 years carries at least seven days and up to six months in jail. The person must also receive a substance use disorder assessment, and a fine of $200 to $750 may be imposed.

A third offense within 10 years carries at least 30 days and up to six months in jail. Wyoming law provides for a substance use disorder assessment, and fines may range from $750 to $3,000.

A fourth or subsequent DUI within 10 years is a felony. It can result in a fine of up to $10,000, imprisonment for up to seven years, or both.

Depending on the circumstances, additional legal consequences may include:

  • Driver’s license suspension or revocation
  • Ignition-interlock requirements
  • Required alcohol or substance abuse assessment or treatment
  • Probation and related conditions
  • Loss of gun rights

Life Consequences of a DUI Conviction

The sentence imposed by a court may be only part of the cost of a DUI conviction. A conviction can create consequences that affect your career, finances, immigration status, and daily life long after the criminal case ends.

A DUI conviction may affect you in several ways:

  • Driving and transportation: A conviction can affect your ability to drive and may lead to transportation problems, ignition-interlock expenses, and increased insurance costs.
  • Employment: People who depend on driving for work, including commercial drivers, delivery drivers, sales representatives, and equipment operators, may face employment consequences if their driving privileges are restricted.
  • Professional licenses: People working in licensed professions may be required to report an arrest or conviction, depending on the rules governing their profession.
  • Background checks: A DUI record may appear during some background checks, potentially affecting applications for employment, housing, professional opportunities, or positions of trust.
  • Immigration: Non-U.S. citizens may face immigration consequences depending on the charge, facts, plea, criminal history, and immigration status involved. A DUI case may also involve additional allegations that raise separate immigration concerns.

Out-of-State DUI Arrests

You do not have to live in Wyoming to face a Wyoming DUI charge. Tourists, business travelers, truck drivers, and people passing through the state can all be arrested here. An out-of-state case can also become complicated because the arrest may affect driving privileges in more than one state. Wyoming may take action in regard to your privilege to drive here, while your home state's licensing agency could impose separate consequences under its own laws.

Working with a Wyoming law firm means having representation from an attorney who is familiar with the state’s DUI laws, local court procedures, and requirements that apply to the case. An in-state attorney can handle court filings, communicate with prosecutors, and address other Wyoming proceedings while keeping an out-of-state client informed. This local representation can make it easier to manage a case from another state and understand what obligations may require the client’s presence in Wyoming.

Reasons to Contact a DUI Lawyer Right Away

Time matters after a DUI arrest. Waiting to get legal help can make it harder to protect your rights and preserve useful evidence. A lawyer can tell you what to do, what not to do, what deadlines may apply, and what evidence should be preserved.

Video may need to be obtained. Witnesses may need to be identified. Records related to breathalyzer or blood test results may need to be examined. There may also be driver's license issues that require prompt attention.

Early legal help is especially important because people sometimes make their situation worse by trying to explain the arrest to police, prosecutors, employers, or others. What seems like an innocent explanation can create new problems.

Case Results

Felony 4th DUI in 10 Years. Charge Dropped.

Our client faced a felony DUI charge involving Ambien, marking a fourth alleged offense within 10 years. After taking over the case, Mr. Titus identified automatism as a key issue and determined that our client may have been a “zombie driver.” An independent professional reviewed the circumstances and concluded that our client could not have been conscious while driving. Steven Titus presented these findings to the Campbell County Attorney’s Office, which agreed it could not meet its burden at trial.

DUI Charge Dismissed

The Campbell County Circuit Court defendant was accused of driving under the influence of alcohol after a deputy initiated a traffic stop for an alleged failure to use a turn signal. Steven Titus and the defendant retained an expert witness who provided evidence indicating that the defendant was likely using the turn signal. The defense argued that the deputy therefore lacked reasonable, articulable suspicion to initiate the traffic stop. The Driving While Under the Influence charge was dismissed.
